Conservative Judge J. Michael Luttig wrote the opinion (pdf) for a U.S. Court of Appeals panel ruling to uphold reasonable legal procedure in the case of Jose Padilla, who has been imprisoned for three years in military custody and faces terrorism charges. How dare the appeals court - and they call themselves judges! The federal court ruling could pose trouble for the Bush Administration, which didn’t reckon that the courts would think the law mattered (a not unreasonable view given the judges the Administration has been appointing to the bench). President Bush had considered Luttig for a Supreme Court position, but now Luttig will be lucky if he gets a “holiday” card from the President.
It’s quite a statement of affairs!
